These Terms and Conditions ("Terms") govern your access to and use of the Critter Connect mobile application (available on the Apple App Store and Google Play Store) and the website at critterconnect.net (collectively, the "Service"), operated by Critter Connect LLC ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Critter Connect is a platform that enables individuals, animal shelters, rescue organizations, and other authorized entities to create profiles and facilitate the responsible rehoming of animals of all kinds.

The Service is not a marketplace for the commercial sale of animals for profit. Users may not list, offer, or transfer animals in exchange for monetary payment or other commercial gain beyond reasonable, documented rehoming or adoption fees that cover actual costs (e.g., veterinary care, transport, or shelter overhead), where permitted by applicable law.

Guests may browse available animals without an account. An account is required to message other users, submit adoption applications, or list animals for rehoming.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use interactive features of the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

Shelters, rescues, and organizations must provide accurate information about their legal status and authority to rehome animals.

3. Account Registration and Security

To access certain features, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. User Conduct and Prohibited Activities

You agree to use the Service only for lawful, ethical, and responsible rehoming purposes. You may not:

• List, offer, or transfer animals for commercial profit or as part of a business selling animals
• Misrepresent an animal's health, temperament, history, or needs
• Engage in any form of animal abuse, neglect, or exploitation
• Post false, misleading, defamatory, or illegal content
• Harass, threaten, spam, or solicit other users
• Use the Service to facilitate illegal breeding, trafficking, or any activity prohibited by animal welfare laws
• Scrape, reverse-engineer, or interfere with the Service's technical operation
• Create multiple accounts to evade restrictions or bans

We may remove content, suspend accounts, or report users to authorities if we believe these rules have been violated.

5. Animal Welfare and Rehoming Responsibility

Users who list animals are solely responsible for:

• Ensuring the animal is legally theirs to rehome
• Providing accurate health, behavioral, and history information
• Complying with all applicable local, state, and federal animal welfare and transfer laws
• Screening potential adopters appropriately

Adopters are solely responsible for evaluating the suitability of any animal and for providing proper care after transfer. Critter Connect does not guarantee the health, temperament, or suitability of any animal and does not participate in or oversee individual transfers.

6. User Content

You retain ownership of content you post (photos, descriptions, messages, etc.). By posting content, you grant Critter Connect LLC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content solely for operating and promoting the Service.

You represent that you have all necessary rights to the content you post and that it does not infringe any third-party rights.

We may remove any content that violates these Terms or that we deem inappropriate, without notice.

7. Intellectual Property

The Service, including its design, logos, trademarks ("Critter Connect"), software, and content (excluding user content), is owned by Critter Connect LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• Any animal listed is healthy, accurately described, or suitable for adoption
• Any user is truthful or qualified
• The Service will be uninterrupted, secure, or error-free

You use the Service and interact with other users at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRITTER CONNECT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY INTERACTIONS WITH OTHER USERS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.

11. Indemnification

You agree to indemnify, defend, and hold harmless Critter Connect LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, your interactions with other users, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

Any dispute arising out of these Terms or the Service shall be resolved exclusively in the state or federal courts located in St. Lucie County, FL, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on the Service and update the "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the Service.
